Tweep — Terms of Service & End-User Licence Agreement

These Terms of Service ("Terms") are a legal agreement between you and TitanByte Ltd ("TitanByte", "we", "us", "our") governing your use of the Tweep mobile application and related services (the "App"). Please read them carefully. By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. The service

Tweep helps you remember things by escalating reminders — gentle nudges that can build up to an alarm designed to break through Silent and Focus. Features include reminder creation, an escalation "ramp", a daily roll-up, optional calendar-based suggestions, and optional sign-in.

2. Eligibility

You must be at least 13 years old (or the minimum digital-consent age in your country, whichever is higher) to use the App. By using it, you confirm you meet this requirement and can form a binding contract.

3. Licence

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use one copy of the App on Apple-branded devices you own or control, for your personal, non-commercial use, in accordance with the Apple App Store Terms of Service (the "Usage Rules"). The App is licensed, not sold. You may not copy, modify, reverse-engineer, decompile, rent, lease, sell, sublicense, or create derivative works from the App except to the extent this restriction is prohibited by law.

4. Your content

You retain ownership of the reminders and content you create ("Your Content"). Your Content is stored on your device; if you enable account features, you grant us a limited licence to host and process it solely to provide the App to you. You are responsible for Your Content and for keeping your own backups.

5. Subscriptions, trials, and billing

Tweep offers an auto-renewable subscription ("Tweep Membership"), and may offer a free trial.

  • Billing through Apple. All purchases are processed by Apple via your App Store account. We do not handle your payment details.
  • Free trial. If a free trial is offered, it converts to a paid subscription unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited if you purchase a subscription.
  • Auto-renewal. A subscription automatically renews for the same period at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
  • Managing and cancelling. You can manage or cancel your subscription in iOS Settings → [your name] → Subscriptions. Deleting the App does not cancel a subscription.
  • Refunds. Purchases are handled by Apple; refunds are subject to Apple's policies, and requests are made to Apple. We cannot directly issue App Store refunds.
  • Price changes. We may change subscription prices; changes apply to future renewals and, where required, only with your consent and advance notice.

The current plans and prices are shown in the App and on the App Store at the time of purchase, and those displayed terms govern.

6. Important: reliability and no safety-critical reliance

Please read this section carefully.

Tweep is a consumer convenience tool, not a guaranteed alerting, medical, safety, or emergency service. Reminders, notifications, and alarms depend on factors outside our control, including: your device being on, charged, and within reach; the permissions you grant; iOS settings such as Silent, Focus, Do Not Disturb, Low Power Mode, and notification limits; operating-system behaviour and updates; and the possibility of software bugs or service interruptions. We do not warrant that any reminder, notification, or alarm will be delivered, on time, or at all.

Do not rely on Tweep as your sole or primary means of remembering anything where failure could cause harm, loss, or serious consequences — for example medication, medical appointments, legal or financial deadlines, childcare, travel, or any safety-critical matter. Tweep is not a medical device and does not provide medical, legal, financial, or professional advice. Always use independent backups for anything critical. You are solely responsible for acting on your reminders.

7. Acceptable use

You agree not to: use the App for any unlawful purpose; interfere with or disrupt the App or its security; attempt to gain unauthorised access to any systems or other users' data; or use the App in any way that violates the rights of others or applicable law.

8. Third-party services

The App relies on third-party services, including Apple (App Store, payments, Sign in with Apple, notifications/alarms), Google (optional sign-in), Supabase (authentication), RevenueCat (subscription management), and PostHog (analytics). Your use of those services may be subject to their own terms and privacy policies, and we are not responsible for their acts or omissions.

9. Intellectual property

The App, including its software, design, "Tweep" name, mascot, logos, and content (excluding Your Content), is owned by TitanByte or its licensors and is protected by intellectual-property laws. These Terms grant you no rights in our trademarks or branding.

10. Disclaimers

To the maximum extent permitted by law, the App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that reminders or alarms will be delivered. Nothing in these Terms excludes or limits rights you have as a consumer that cannot be excluded under the law of your country.

11. Limitation of liability

To the maximum extent permitted by law, TitanByte and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, opportunities, or goodwill, arising out of or related to your use of (or inability to use) the App or any failure of a reminder, notification, or alarm. To the extent we are found liable, our total aggregate liability for all claims relating to the App is limited to the greater of (a) the amount you paid us for the App in the 12 months before the claim, or (b) GBP £50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing here limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law.

12. Indemnity

To the extent permitted by law, you agree to indemnify and hold TitanByte harmless from claims and expenses arising out of your misuse of the App or your breach of these Terms.

13. Termination

We may suspend or terminate your access if you breach these Terms or if we discontinue the App. You may stop using the App at any time and delete it. Sections that by their nature should survive termination (including 4, 6, 9–13, and 15) will survive.

14. Changes to these Terms

We may update these Terms. We will post the revised Terms with a new "Last updated" date and, for material changes, provide reasonable notice. Continued use after changes take effect means you accept the revised Terms.

15. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere, you may benefit from any mandatory protections and the courts of your country of residence as required by local law.

16. Apple-specific terms

You acknowledge that these Terms are between you and TitanByte only, not Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App, including product-liability, legal/regulatory, or intellectual-property claims. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting," and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
